This Privacy Policy explains how TWD Fitness Management, Inc., a California corporation doing business as "Train With Dave" ("Train With Dave," "we," "us," or "our") collects, uses, and shares information when you visit trainwithdaveoc.com (the "Site"), book a consultation, fill out a form, chat with our website assistant, or otherwise interact with our services.
1. Who we are
Train With Dave is a personal training company headquartered in Orange County, California, operating studios in Orange, Irvine, and Laguna Hills. You can reach us at info@trainwithdaveoc.com or 714-904-2036.
2. Information we collect
We collect information in three ways:
- Information you give us directly. When you book a free consultation through our scheduling system, fill out a contact form, send an email, or chat with our website assistant, we collect the information you provide — typically your name, email, phone number, and any goals or background you choose to share.
- Information collected automatically. When you visit the Site, we and our third-party providers automatically collect standard log data (IP address, browser type, pages viewed, time on page, referring URL) and behavioral analytics (mouse movement, scroll depth, click events) using tools described in section 5.
- Information from third parties. When you book a consultation through Calendly or interact with us through Google Business Profile, Instagram, Threads, Pinterest, or other third-party platforms we use, those platforms may share information with us (such as your name, email, the time you booked, or the message you sent).
3. How we use your information
We use the information we collect to:
- Schedule, deliver, and follow up on personal training consultations and sessions.
- Respond to questions you send through forms, email, text, or chat.
- Send transactional messages (booking confirmations, session reminders, account-related notices).
- Send marketing emails about our services, programs, and content — only to people who have opted in. You can unsubscribe at any time using the link at the bottom of any marketing email.
- Improve our website and content (which pages convert, where visitors get stuck, what topics drive demand).
- Comply with legal obligations and enforce our Terms.
4. Cookies and tracking
The Site uses cookies and similar technologies to remember your preferences, measure performance, and attribute conversions. You can disable cookies in your browser settings; some parts of the Site may not function properly without them.
5. Third-party services
We use the following third-party services to operate the Site and our business. Each has its own privacy policy that governs how it handles your data:
- Calendly — booking and scheduling.
- Anthropic — powers our website assistant (chatbot). Conversations are processed by Anthropic's API to generate responses.
- Resend — transactional and marketing email delivery.
- Kit (formerly ConvertKit) — email list management.
- Microsoft Clarity — privacy-friendly behavioral analytics (heatmaps, session recordings).
- Google Analytics 4 and Google Ads — site analytics and conversion tracking.
- Meta Pixel — advertising attribution for Instagram and Facebook campaigns.
- Vercel — website hosting and infrastructure.
- Upstash Redis — session and lead storage.
- Square and Trainerize — billing and client management for active clients.
- Buffer, Pinterest, Instagram, Threads, X (Twitter), YouTube, and Google Business Profile — social and search platforms where we publish content.
6. How we share information
We do not sell your personal information. We share information only with:
- The third-party service providers listed above, to the extent needed to operate the Site and our business.
- Our trainers and staff who need it to deliver your sessions.
- Law enforcement or other parties when required by law, subpoena, or to protect our legal rights.
7. Data retention
We retain personal information for as long as your relationship with us is active and for a reasonable period afterward to comply with legal obligations, resolve disputes, and enforce agreements. Marketing email subscribers can unsubscribe at any time, after which their data is removed from active marketing lists.
8. Your rights
Depending on where you live, you may have the right to access, correct, delete, or port your personal information, or to opt out of certain processing. California residents have specific rights under the California Consumer Privacy Act (CCPA). To exercise any of these rights, email us at info@trainwithdaveoc.com and we will respond within the timeframe required by law.
9. SMS / text message program
Program description. Train With Dave operates an SMS program that sends informational and conversational text messages to people who have opted in. Message types include: an immediate confirmation text after you submit a contact or booking form, multi-stage follow-up messages if you have not yet booked a consultation, booking-abandonment recovery messages if you started but did not finish a booking, appointment reminders, and direct replies from the studio when you ask questions.
How you opt in. You opt in to the SMS program by submitting the contact form on trainwithdaveoc.com/book or trainwithdaveoc.com/contact with the SMS-consent checkbox checked. The consent language adjacent to the submit button reads: "By submitting, I agree to receive automated text messages and emails from Train With Dave at the phone number provided regarding my inquiry, including booking reminders and follow-up. Msg frequency varies. Msg & data rates may apply. Reply HELP for help, STOP to cancel." Consent to receive SMS is not a condition of purchasing any product or service from Train With Dave.
Message frequency. Message frequency varies based on your interaction with us. You will typically receive 1–4 messages following a contact-form submission as part of our follow-up sequence, and additional transactional messages (such as appointment reminders) if you book a session.
Carrier fees. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
Opt out / help. You can opt out of SMS at any time by replying STOP, CANCEL, END, QUIT, or UNSUBSCRIBE to any text from us. You will receive one confirmation message and no further texts. Supported carriers. AT&T, T-Mobile, Verizon, US Cellular, and other major US carriers.
Privacy. We do not share your mobile information with third parties or affiliates for marketing or promotional purposes. Mobile information sharing is limited to subprocessors that support the messaging program itself (for example, our SMS delivery provider Twilio). All other categories — including phone numbers collected for SMS — are subject to the same retention, access, and deletion rights described elsewhere in this policy.
9b. Email opt-out
You can opt out of marketing emails by clicking the unsubscribe link in any email. Transactional messages (booking confirmations, session reminders) cannot be opted out of while you are an active client.
10. Children
The Site is intended for adults. We do not knowingly collect personal information from anyone under 16. If we learn we have collected information from a child under 16, we will delete it.
11. Security
We use industry-standard technical and organizational measures to protect your information. No system is perfectly secure; we cannot guarantee absolute security.
12. Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will be communicated by email to active clients.
